Milwaukee bar accused of illegal tipping practices in new federal lawsuit
Another well-known Milwaukee bar and restaurant is facing a federal lawsuit over tipping practices an employee says violated the Fair Labor Standards Act.
Steny’s Tavern and Grill, doing business as Steny’s, Inc., and its registered agent Jerome K. Stenstrup are named in the civil complaint filed by Nathan Witman, a Steny’s front-of-house employee. The lawsuit was filed Feb. 12 in the Eastern District of Wisconsin.
The suit alleges Steny’s, 800 S. 2nd St., operates an unlawful mandatory tip pool that includes kitchen workers, who do not customarily receive tips, and wrongfully claimed a tip credit it was not entitled to receive.

A tip credit is a provision under the Fair Labor Standards Act that allows an employer to count a portion of a tipped employee’s tips towards the employer’s obligation to pay that employee per workweek an amount equal to the minimum wage and overtime compensation required under the FLSA. In Wisconsin, the minimum wage is $7.25.
Witman is one of at least 40 employees affected by the tip pool, the lawsuit says.
Stenstrup did not immediately return a message seeking comment on the lawsuit. Steny’s operates two locations, the Walker’s Point restaurant named in the suit and a location in Pewaukee.
A similar lawsuit alleging illegal tipping practices at the St. Paul Fish Company’s Milwaukee Public Market location was filed in January. That suit claims the seafood restaurant illegally allowed its managers to take tips set aside for other restaurant workers.
